Petition filed to transfer accused New Year’s attacker to adult court

MEADVILLE — One of two male juveniles accused in the New Year’s Day attack on a 34-year-old Meadville man may soon be facing charges as an adult.

The victim of the 3 a.m. attack, which took place outside the CVS pharmacy at the corner of North and Liberty streets in downtown Meadville, was taken by ambulance to Meadville Medical Center and later transported to UPMC Hamot in Erie.

A 16-year-old suspect has been charged with aggravated assault, criminal conspiracy, two counts of simple assault, recklessly endangering, and two counts of harassment. A 15-year-old suspect has been charged with aggravated assault, criminal conspiracy, simple assault and harassment. All juvenile court proceedings are closed and documents are not made available to the public; as a result, the names of the suspects have not been released.

The Crawford County district attorney’s office has filed a petition to have the 16-year-old suspect’s case transferred from juvenile court to adult criminal court, District Attorney Francis Schultz announced Monday. When juvenile charges were filed Jan. 15, Schultz termed the attack “a vicious assault.”

In a prepared statement released Monday, Schultz explained that “based on the 16-year-old suspect’s history of committing delinquent acts, his inability to change his behavior, the severity of the charges and the impact on the victim, I believe that his case must be handled in adult criminal court. It appears that despite the best efforts of the Juvenile Probation Department, this suspect simply cannot be effectively dealt with in the juvenile system.”

A hearing will be set and the court will decide whether to grant his office’s petition for transfer, Schultz said, adding that the 15-year-old suspect’s case will stay in juvenile court.
